Terms of Service

1. Service Description

ClinOps (operated under the Docera brand) is a multi-tenant Software-as-a-Service (SaaS) clinic management platform designed for small and mid-sized healthcare clinics in India. The service includes patient management, consultation records, prescriptions, billing, and appointment scheduling.

2. Acceptable Use

The platform is licensed exclusively for lawful healthcare management purposes. Users must not: (a) use the platform to store data for patients without their consent; (b) attempt to access other clinics' data; (c) reverse-engineer or circumvent security controls; (d) use the platform for any purpose other than clinical operations.

3. Data Ownership

Each clinic owns their own patient data. ClinOps acts as a data processor on behalf of the clinic (the data controller). ClinOps does not claim ownership of any clinic's patient records and will not use clinic data for any purpose other than providing the service.

4. ClinOps Responsibilities

ClinOps will maintain the platform with reasonable uptime (99% target), implement appropriate security measures, and provide data export functionality upon request. We reserve the right to suspend accounts for non-payment or policy violations with notice.

5. Limitation of Liability

ClinOps is a practice management tool and does not provide medical advice. Clinical decisions remain solely the responsibility of the treating physician. ClinOps' liability is limited to the subscription fees paid in the 3 months preceding any claim.

6. Governing Law

These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India. Use of this platform implies compliance with applicable Indian regulations including the IT Act 2000, DPDP 2023, and the Indian Medical Council regulations.
